Arco Terms of Service

Welcome to Arco! By accessing or using our platform, you agree to be bound by these Terms of Service.

1. Platform Overview

Arco is a software-as-a-service (SaaS) platform designed to help archery clubs manage tournament operations, registrations, and administrative tasks.

2. Account Registration & Age Requirements

  • Organisers: You must be 18 years or older and authorized by your archery club to create a workspace and collect payments.
  • Archers & Minors: While minors are welcome and encouraged to participate in archery events managed via Arco, all registrations for individuals under the age of 18 must be completed by a parent, legal guardian, or authorized club official.

3. Payments, Fees, and Refunds

  • Payment Processing: All event registration payments are processed securely through Stripe. Arco facilitates the transaction between the archer and the host club.
  • Refund Policy: Arco provides the ticketing software but does not manage club finances. Arco does not issue refunds to archers. All refund requests, cancellations, and disputes must be handled directly with the host club according to their specific event prospectus.
  • Platform Subscriptions and Billing: The Arco Club Pass is an annual subscription service. By activating a Club Pass, you agree that your subscription will automatically renew every 12 months at the then-current annual rate. The payment method on file will be charged automatically on your billing anniversary date. Club administrators can cancel their subscription at any time via the "Manage Billing" section within the Arco dashboard. To avoid the next annual charge, you must cancel before your renewal date. We do not offer prorated refunds for mid-year cancellations, but you will retain full access until the end of your current paid cycle.

4. Liability and Event Safety

Arco provides administrative software; we do not organize, host, or oversee the physical archery events.

  • The Host Club is solely responsible for the safety, execution, and legal compliance of their tournaments, including conducting risk assessments, managing field parties, and adhering to the rules of their governing body (e.g., Archery GB).
  • Arco accepts no liability for personal injury, property damage, or other incidents that occur at events managed using our software.

5. Service Availability

While we strive for 100% uptime, Arco is provided on an "as is" and "as available" basis. We reserve the right to modify, suspend, or discontinue components of the service for maintenance or upgrades.

6. Termination

We reserve the right to suspend or terminate any club workspace or user account that violates these terms, engages in fraudulent activity, or uses the platform to distribute harmful content.

7. Data Protection and Privacy

Arco takes the privacy of your data seriously. In operating the platform, Arco acts as a Data Processor, while the Host Club remains the Data Controller for all archer and attendee information collected. We will only process personal data in accordance with our Privacy Policy and applicable data protection laws, including the UK GDPR. Host Clubs are responsible for ensuring they have the necessary lawful basis to collect and share their members' data via the Arco platform.

8. Limitation of Software Liability

To the maximum extent permitted by law, Arco shall not be liable for any indirect, incidental, or consequential damages, including lost profits, lost data, or business interruption arising from the use or inability to use the platform. In no event shall Arco’s total liability for any claims arising under these Terms exceed the total amount paid by your club to Arco for the SaaS subscription in the twelve (12) months preceding the claim.

9. Intellectual Property and Content

Arco's IP: Arco retains all rights, title, and interest in the platform, including its software, design, and branding. You may not copy, modify, or reverse-engineer any part of the service.

‍Your Content: You retain all ownership rights to the data, logos, and event information you upload to Arco. By uploading content, you grant Arco a limited, non-exclusive license to host, display, and process this content solely for the purpose of operating the platform.

10. Third-Party Payment Processor

Payment processing services for organizers on Arco are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service. By agreeing to these terms or continuing to operate as an organizer on Arco, you agree to be bound by the Stripe Services Agreement, as the same may be modified by Stripe from time to time.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to these Terms

We reserve the right to update or modify these Terms of Service at any time. If we make material changes, we will provide notice through the platform or via email before the changes take effect. Your continued use of Arco after the effective date of any changes constitutes your acceptance of the updated Terms.
